О.В. Корнеева Построение взаимоотношений в системе «деликтная ответственность — страхование»: зарубежный опыт

Аннотация: В статье на примере обязательств из причинения вреда в результате ДТП как наиболее распространенной категории деликтов анализируется зарубежный опыт построения взаимоотношений между деликтной ответственностью и страхованием. Автором рассматриваются основные подходы к оптимизации взаимоотношений в системе «деликтная ответственность-страхование». Делается вывод о возможности заимствования отдельных положений российской практикой.

Abstract: The basic models of construction of mutual relations in system tort liability — the insurance compensation, allocated on the basis of the analysis of the legal doctrine and the legislation of foreign countries are considered in the article. The conclusion about possibility of loan of separate elements of these models by the Russian practice is made.
