Аннотация:
В данной статье обозреваются основные этапы становления института необходимой обороны, а также ключевые моменты эволюции положений об основных признаках ее правомерности в праве Великобритании в период с X в. по настоящее время. Автором рассматривается влияние статутного и общего права на развитие законодательства о необходимой обороне, в частности, на такие элементы данного правового института, как превентивная оборона, фактическая ошибка обороняющегося, защита имущества. Дается краткий обзор актуального законодательства Великобритании о необходимой обороне. Автором отмечается особая роль прецедента при формировании института необходимой обороны в английском праве, делается вывод о том, что именно индивидуальный подход апелляционных инстанций к судебным делам по обстоятельствам необходимой обороны и детальный анализ всех элементов объективной и субъективной стороны рассматриваемых дел позволили выделить и зафиксировать необходимые правовые элементы института необходимой обороны. Таким образом, в настоящее время развитый институт необходимой обороны в Великобритании является дополнительной гарантией защиты прав и свобод человека, и необходимым элементом правого государства и гражданского общества.

Abstract: This article surveys the main stages of the institution of self-defense, as well as the key points of the evolution
of the provisions of the basic attributes of its legality in the UK law from X century until now. The author examines the
impact of statutory and common law on the development of the legislation on self-defense, in particular, such elements
of the legal institution, as a preventive defense, defending factual error, the protection of property. A brief review of the
current UK law on self-defense is given.
The author notes the special role of precedent in the formation of institutions of self-defense in English law, it is concluded
that this personal approach of appellate courts to judicial cases on the circumstances of self-defense and in-depth
analysis of all elements of the objective and subjective sides of cases make possible to identify and secure the necessary
legal elements of institute of defense. Thus, at the present time development of the institution of self-defense in the UK
is an additional safeguard to protect human rights and freedoms, and an essential element of a law state and civil society.
