Осминин Участие парламента в принятии решений о согласии государства на обязательность международных договоров (сравнительно– правовой анализ)Аннотация: Статья посвящена роли парламентов различных государств в принятии решений о согласии на обязательность международных договоров. Во многих государствах парламентское одобрение является юридически обязательным для заключения наиболее важных международных договоров.Парламентское одобрение во все возрастающей степени становится предварительным условием внутригосударственного действия международных договоров. В некоторых государствах (Великобритания, Австралия, Канада) парламентское одобрение не является юридически необходимым для принятия международных договорных обязательств. Отсутствие неодобрения парламента считается достаточным для принятия решения о ратификации договора. Ключевые слова: Cравнительное правоведение, парламентское одобрение международных договоров, парламентский контроль, явно выраженное одобрение, подразумеваемое одобрение, отсутствие неодобрения, договоры, конгрессистско–исполнительные соглашения, исполнительные соглашения в соответствии с договорами, президентские исполнительные соглашенияAbstract: The article is devoted to the role of the parliaments of various countries in the decision–making on the consent to be bound by international treaties. In many states parliamentary approval is legally binding for the conclusion of the most important international treaties. Parliamentary approval increasingly has become a precondition for the internal effect of international treaties. In some countries (the United Kingdom, Australia, Canada) parliamentary approval is not legally necessary for the adoption of the international treaty obligations. The absence of disapproval of parliament is considered to be sufficient for the adoption of a decision on the ratification of the treaty.
