Аннотация: Цель статьи проанализировать роль Верховного суда США в формировании и развитии конституционного права. Представлены подходы основных юридических школ к проблеме конституционного право- творчества. Исследование анализирует судебную активность в различных измерениях. Автор показывает, как Верховный суд выступал в качестве реакционных или прогрессивных сил в критические исторические моменты.

Abstract: This article aims at analyses of the U.S. Supreme Court’s role in forming law. Key concepts of legal scholars are presented. Study analyses judicial activism across a variety of dimensions. The author reveals how the Supreme Court has served as a reactionary or progressive force at the critical historical moments.
