Танчев Е. Конституционный плюрализм и многоуровневое управление в Европейском Союзе

Аннотация: В статье рассматриваются вопросы многоуровневого управления в ЕС в свете конституционного плюрализма. Автор отмечает, что в современном глобальном мире конституционный плюрализм бросает вызов традиционным правовым учениям, не способным предложить решение вновь возникающим проблемам. При этом сама европейская интеграция трансформировала правовой плюрализм, основывающийся на взаимном существовании национального и международного права, во взаимодействие между различными уровнями конституционных институтов. Современный процесс глобализации все еще находится в поиске своего собственного конституционного порядка и верховенства права и глобальные стандарты взаимодействия с национальными правовыми системами все еще опираются на принцип pacta sunt servanda. Распространение конституционной организации власти на глобальный уровень тесно связано с понятием общественного конституционализма, имеющего отношение к расширению объема правового регулирования, что стало одной из основных тенденций конституционного развития четвертого поколения. Общественный конституционализм сосредотачивает внимание на увеличении числа субъектов, принимающих участие в процессе принятия политических решений, и накладывает ограничения на их действия. Автор отмечает возрастающую значимость международно-правовых стандартов и норм «мягкого права». Они выполняют роль связующего звена между национальным и глобальным конституционализмом и обеспечивают совместимость различных правовых систем в рамках современного конституционного плюрализма.

Abstract: The article considers the issues of multi-level governance in the EU in the light of constitutional pluralism. The author notes that in contemporary global age constitutional pluralism poses challenges to traditional legal theory failure to explain emerging new issues. At the same time European integration transformed the legal pluralism built on the coexistence of national and international law into interaction between various levels of constitutional arrangements. Globalization is still looking for its own constitutional order and the rule of law and global standards interaction with national constitutional orders has still to rely on pacta sunt servanda principle. Expanding constitutional governance at global level is related to the concept of societal constitutionalism relating to broadening the scope of regulation which has been one of the main trends in the fourth constitutional generation. Societal constitutionalism concerns the increasing number of actors in political decision-making process and poses limitations on their actions. The author notes the growing importance of international legal standards and norms of «soft law». International legal standards are within this context a linkage between national and global constitutionalism. They provide compliance of different legal orders of contemporary constitutional pluralism.
