Жолобова Г.А. Механизм правового регулирования торговли ядовитыми и сильнодействующими веществами в Российской империи 1881 – 1913 гг.

Аннотация: В статье подняты актуальные проблемы истории законодательства Российской империи, регулировавшего отношения в сфере частной торговли ядовитыми и сильнодействующими веществами в конце XIX – начале XX веков. Показано формирование механизма правового регулирования, способствовавшего как правильной организации такой торговли, так и установлению должного надзора в целях обеспечения государственной и общественной безопасности и народного здравоохранения; выявлены существовавшие в изучаемой сфере трудности и противоречия, проанализированы проблемы и особенности реализации соответствующих правовых норм. Отдельно автор остановилась на проблемах законодательного регулирования организации торговли азотной кислотой, чему в исследуемый период уделялось особое внимание в связи с усилением в стране террористического движения и ее использованием для изготовления взрывчатых веществ. На основе анализа нормативно-правовых актов, содержащихся в Полном собрании законов Российской империи и норм Свода законов Российской империи, а также найденных архивных документов, которые вводятся в научный оборот впервые, механизм правового регулирования представлен на всех его стадиях. The article raises actual historical problems of Russian Empire legislation, regulating relations in the sphere of trade of toxic and drastic substances. The author shows the formation of legal regulation mechanism, which must promote not only the organization of trade but also laying down a due supervision to ensure state security and welfare. On the ground of studying documents the author reveals the characteristics and problems of implementation of relevant legal rules.

Abstract: The article discusses actual historical problems of the legislation of the Russian Empire regarding regulation of the relations in the sphere of trade of toxic and drastic substances in late XIX — early XX centuries. The author shows the formation of the mechanism for the legal regulation, which was aimed to promote the organization of trade, as well as to provide for the due supervision in order to guarantee state security and public welfare. The author reveals existing difficulties and contradictions, analyzes the problems and specific features of implementation of relevant legal rules. The author paid special attention to the problems of legislative regulation of the organization of trade in the azotic acid. Special attention to azotic acid was due to the strengthening of the terrorist activities in the Empire and the use of the azotic acid for making the explosives. Based upon the analysis of normative legal acts provided in the Complete Collection of Laws of the Russian Empire and the norms of the Code of Laws of the Russian Empire, as well as some newly found archive documents, which are being introduced into the scientific turnover for the first time, the author studies the mechanism of the legal regulation in the relevant spheres at all of its stages.
